Paradise Cycling Terms and Conditions

These Terms and Conditions form the basis of your contract with Paradise Cycling Tours Unipessoal Lda (“Paradise Cycling”, “we”, “us”, “our”). By making a booking with us, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.
1. Company Information
1.1 These Terms and Conditions govern the cycling holiday services provided by Paradise Cycling Tours Unipessoal Lda, a company registered in Portugal and licensed by the national tourism authorities under RNVAT: 11760.
1.2 Paradise Cycling Tours Unipessoal Lda is the sole provider of all services offered via the website https://paradise-cycling.com.
1.3 These Terms form a legally binding contract between you and Paradise Cycling upon written confirmation of your booking and receipt of payment.
2. Making a Booking
2.1 Bookings are accepted only from persons aged 18 years or over at the time of booking.
2.2 By making a booking, you confirm that you are legally capable of entering into a binding contract, that you have read and accepted these Terms in full, and that all information provided is accurate and complete.
2.3 Where a booking is made on behalf of other participants, the person making the booking confirms that they have authority to accept these Terms on behalf of all participants and accepts responsibility for ensuring all participants comply with them.
2.4 Paradise Cycling offers the following categories of cycling holidays:
Fixed Dates Tours are guided cycling tours with set dates advertised on the website.
Guided Tours are guided cycling tours arranged on dates agreed with the customer following a booking request.
Self-Guided Tours are cycling tours without a guide, arranged on dates agreed with the customer following a booking request.
Wellness Retreats are cycling and yoga retreats held on fixed dates in the Algarve.
3. Responsibility for Minors
3.1 Participants under the age of 18 may only take part in a Paradise Cycling activity where expressly agreed in writing by Paradise Cycling in advance.
3.2 Any participant under the age of 18 must be accompanied at all times by a parent or legal guardian, or by a responsible adult with written authorisation from the parent or legal guardian.
3.3 The accompanying adult accepts full responsibility for the supervision, conduct, safety, and wellbeing of the minor and accepts liability for any damage, loss, injury, or disruption caused by the minor.
3.4 We reserve the right to impose minimum age limits or skill requirements depending on the nature of the activity.
4. Payment
4.1 A deposit is required at the time of booking in order to secure your place. The contract comes into effect upon written confirmation of the booking and receipt of the deposit.
4.2 The balance must be paid in full by the date specified at the time of booking confirmation. Failure to pay by the due date may result in cancellation of your booking.
4.3 We reserve the right to amend prices prior to receipt of full payment where increases in costs occur beyond our reasonable control, including supplier costs, taxes, or government levies.
4.4 Payments made by card will incur an additional charge. This can be avoided if payment is made via bank transfer or direct debit.
5. Amendment or Cancellation by You
5.1 You may cancel your booking at any time before the start date by written notice from the lead booking name. Cancellation charges apply as follows.
5.1.1 Fixed dates tour: A deposit of 20% is due on booking. This is fully refundable up to 30 days before the start date. The balance is due 30 days before the start date. From 29 days before, until the start date, all base costs (including single supplement) are non-refundable. All add-ons, such as bike hire, are fully refundable until 2 days before the start date.
5.1.2. Guided tour. A deposit of 20% is due on booking. This is fully refundable up to 30 days before the start date. The balance is due 30 days before the start date. 5.1.3. Self-guided tour. A deposit of 20% is due on booking. This is fully refundable up to 30 days before the start date. The balance is due 30 days before the start date. From 29 days until the start date, the deposit is non-refundable. The balance is refundable until 10 days before the start date. All add-ons such as bike hire are refundable until 2 days before the start date.
5.1.4. Wellness and Yoga Retreats. Same as the Fixed Dates Tour.
5.2 Different cancellation terms may apply to custom or specially arranged tours and will be confirmed in writing at the time of booking. We will need to talk through different policies for types of tour.
5.3 Amendments may incur additional administrative or operational charges.
6. Transferring Your Booking
6.1 You may request to transfer your booking to another person, provided they meet participation requirements and reasonable written notice is given.
6.2 Any outstanding balance must be paid prior to transfer.
6.3 An administration fee may apply.
7. Amendment or Cancellation by Us
7.1 We reserve the right to amend routes, accommodation, guides, timings, support services, or other logistical arrangements where reasonably necessary.
7.2 If we must cancel a booking for reasons within our control, we will offer either a suitable alternative or a refund of monies paid.
7.3 We shall not be liable for additional personal expenses incurred as a result of changes or cancellation.
8. Unavoidable or Extraordinary Circumstances
8.1 We shall not be liable for failure or delay in performance where such failure results from events beyond our reasonable control, including severe weather, natural disasters, acts of government, pandemics, civil unrest, war, terrorism, or road closures.
8.2 In such circumstances, we reserve the right to modify, postpone, or cancel arrangements. Liability shall be limited to refunding monies paid where appropriate.
9. Assumption of Risk and Cycling Safety
9.1 Cycling involves inherent risks including traffic hazards, varying road conditions, weather, mechanical failure, collisions, and falls.
9.2 By participating, you acknowledge and voluntarily accept these inherent risks.
9.3 Participants must wear an approved cycling helmet at all times while riding, obey traffic laws, follow staff instructions, and ride responsibly.
9.4 We reserve the right to remove any participant whose behaviour poses a safety risk.
10. Equipment Responsibility
10.1 Participants are responsible for the proper use and care of any bicycles, accessories, or equipment provided by Paradise Cycling.
10.2 Any loss or damage beyond normal wear and tear caused by misuse, negligence, or failure to follow instructions may be charged to the participant. In particular, in the event of a crash, significant charges may be raised due to damage to a rented bicycle, equipment, accessories or other equipment. Participants are responsible for ensuring that they have adequate travel insurance to cover these costs.
10.3 Participants using their own equipment are responsible for ensuring it is safe, roadworthy, and suitable for the activity.
10.4 Mechanical issues that arise from normal wear or unforeseen breakdown may require route adjustments and do not constitute breach of contract.
11. Medical and Dietary Requirements
11.1 You must inform us at the time of booking of any relevant medical conditions, injuries, allergies, or dietary requirements.
11.2 By booking, you confirm that you are medically fit to participate.
11.3 We reserve the right to refuse participation where a health condition may pose a risk.
12. Our Liability
12.1 We will perform services with reasonable skill and care. We have Civil Liability insurance through Fidelidade, details of which can be found here.
12.2 We shall not be liable for loss or theft of personal belongings, damage to personal equipment, or indirect or consequential losses.
12.3 Where proven at fault, our total liability shall be limited to a maximum of three times the total booking price.
12.4 Nothing excludes liability for death or personal injury caused by our negligence or any liability that cannot legally be excluded.
13. Travel Insurance
13.1 It is a condition of booking that participants obtain adequate travel insurance covering cycling activities, medical expenses, cancellation, and personal belongings.
13.2 You are responsible for ensuring your policy provides appropriate coverage.
14. Photography and Marketing
14.1 During tours, photographs and video footage may be taken for promotional purposes.
14.2 Photographs and videos taken will only be used on social media and the website paradise-cycling.com with the expressed, verbal consent of the participant.
15. Data Protection
15.1 We process personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (EU) 2016/679.
15.2 Personal data is used for booking administration, operational delivery, and customer communication.

16. Complaints
16.1 If you have a complaint during your tour, you must inform a member of staff as soon as reasonably possible to allow us the opportunity to resolve the issue.
16.2 Any formal complaint must be submitted in writing within 14 days of the end of the tour.
17. Behaviour
17.1 Participants are expected to behave respectfully toward others, staff, local communities, and in compliance with local laws.
17.2 We reserve the right to remove any participant without refund for unsafe, abusive, disruptive, or unlawful behaviour.
18. Governing Law and Jurisdiction
18.1 These Terms and Conditions are governed by the laws of Portugal.
18.2 Any disputes arising shall be subject to the exclusive jurisdiction of the Portuguese courts.
19. Severability
19.1 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
